Material consideration: not in front of inspector at appeal

Langmead v Secretary of State for Housing, Communities and Local Government [2018] EWHC 2202 (Admin) (17 August 2018)

Inspector was under no duty to consider landscape mitigation proposals.  Although they were a material consideration, it had not featured in the appeal case and it was not so evidently relevant that the inspector was required to consider it of her own accord
