Material consideration: determining whether taken into account from resolution

R (Midcounties Co-operative Limited) v Forest of Dean District Council [2017] EWHC 2056 (Admin) –

para 100 – “The fundamental difficulty with that submission by Mr Fraser QC is that nothing of that sort appears in the resolution passed by the Council at its meeting on 20 October 2016. It is common ground that that is where the reasons for the decision under challenge are to be found.”

para 102 “…Very often, as the authorities I have cited earlier make clear, it will be possible to discern what the reasons for a decision are from the fact that the local planning authority has accepted the recommendation of its Officers, in which case one can reasonably be expected to go to the Officers’ report in order to find a fuller statement of what the reasons were. This is not such a case.
