Housing supply: deliverability: sites with planning permission

The case contains examples of where sites with planning permission did not form part of the five years’ supply of deliverable sites (see para 22 of judgment and footnote 11 of the NPPF 2012 for the definition of ‘deliverable’).  The court did not find anything wrong with the way the inspector dealt with the difficult decision of determining whether there was a five year supply when the number of deliverable houses was in fact  a range between figures slightly below and above the number needed for a five year supply.
