EIA: use of s106 obligations to address shortcomings

Court of Appeal   disapproved of the use of planning obligations to carry out later assessment as a means of addressing shortcomings in EIA given that the object of the Directive and Regulations is to ensure that environmental impacts are assessed before the decision is taken whether permission should be granted.
