The Inspector decided that the ground of appeal under regulation 118 would succeed because the Council’s demand notice had the wrong commencement date as the date they had on it was 10 months before planning permission was granted.
Appeal decision against Northamptonshire Council dated 20 August 2019
In this decision the demand notice used a date that was 5 days later than the actual commencement date. Because that later date favoured the appellant, the appeal under the ground in regulation 118 of the CIL regs did not succeed.
